These Terms of Service (“Terms”) govern your access to and use of 3ADine (“3ADine”, “we”, “us”, “our”), including the 3ADine web application, QR menu, ordering, and related services (the “Service”). By creating an account or using the Service, you agree to these Terms.

1. Who we are

3ADine provides software tools for restaurants and food businesses, including digital menus, order workflows, and operational features.

2. Eligibility and account

• You must be at least 18 years old and able to form a binding contract.
• You are responsible for safeguarding your login credentials and all activity under your account.
• You must provide accurate and up-to-date information.

3. Free trial and subscriptions

• We may offer a free trial. Trial features and duration may change.
• Paid plans, pricing, taxes, and billing terms will be shown at checkout or in your admin settings.
• If you fail to pay, we may suspend or restrict access to paid features.

4. Acceptable use

You agree not to:

• Use the Service for unlawful, harmful, fraudulent, or abusive activities.
• Attempt to bypass security, rate limits, or access data you do not own.
• Reverse engineer or copy the Service except as permitted by law.

5. Restaurant content and responsibility

• You are responsible for your menu data, pricing, images, and all content you upload (“Customer Content”).
• You are responsible for compliance with food safety, allergen, labeling, and consumer protection laws.
• We do not guarantee the accuracy of menu content, availability, or order fulfilment.

6. Orders and payments

• The Service may support “Pay at counter” and online payment options (where enabled).
• Payment processing may be provided by third-party processors and subject to their terms.
• Chargebacks, refunds, and disputes are your responsibility unless stated otherwise.

7. Data, privacy, and security

Our processing of personal data is described in our Privacy Policy. You agree to comply with applicable data protection laws for any personal data you collect through the Service.

8. Service availability

We aim to provide a reliable service but do not guarantee uninterrupted availability. We may modify, suspend, or discontinue parts of the Service.

9. Intellectual property

• The Service, software, and branding are owned by 3ADine or its licensors.
• You retain ownership of your Customer Content.
• You grant us a limited license to host and process your Customer Content to provide the Service.

10. Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, fail to pay (for paid plans), or if required by law.

11. Disclaimers

The Service is provided “as is” and “as available”. To the extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of liability

To the maximum extent permitted by law, 3ADine will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill.

13. Changes to these Terms

We may update these Terms. If changes are material, we will take reasonable steps to notify you. Continued use after changes means you accept the updated Terms.
